On most private owner financed land deals the seller keeps legal title until the balance is paid. What the buyer holds from day one is a signed land contract, which is equitable title: the right to receive the deed once the payments are complete. It is the same role a lien plays for a bank. The right to the deed once you complete the payments. Isn't that risky for me? This isn't exotic. It's the same role a lien plays for a bank. A bank lends you money and puts a lien on land you own. A private seller skips the lending step and keeps the title instead. Same idea, different mechanics. Ask two things. What deed type you'll get, and that it gets recorded with the county.
